The Beginning of Riverboat Gambling
Throughout the 19th and early 20th centuries, paddlewheel riverboats were a primary mode of transporting goods and passengers along major rivers and their tributaries. However, as railroads became more efficient and widely used, riverboats gradually lost their prominence in transportation.
With this shift, riverboats found a new purpose—entertainment excursions. These leisurely cruises, often lasting several hours, became a popular way for people to escape the heat while enjoying live music and dancing.
Gambling also became a common pastime on these riverboats, with slot machines and card games drawing in passengers. This growing popularity eventually led to the legalization of riverboat casinos in the later part of the 20th century, transforming them into a unique attraction for gaming enthusiasts.
Distinctive Rules of Riverboat Gambling
Riverboat casinos came with a set of unique regulations. One of the primary rules was that gambling had to take place on water, not land. Casinos were required to operate on vessels capable of sailing, and in some regions, gambling was only permitted while the ship was actively moving.
The industry flourished in states along the Mississippi River, where approval led to a boom in riverboat casinos. Missouri, Mississippi, Louisiana, Indiana, and Illinois became key hubs for this form of gambling. The Chicago area emerged as a major hotspot due to the Mississippi River’s connection through the Chicago Sanitary and Ship Canal, while Northwest Indiana saw the rise of several casinos operating within Lake Michigan’s harbors.
The Virginia-Maryland Riverboat Casino Loophole
During the mid-20th century, a unique legal situation emerged due to differing gambling laws in Virginia and Maryland. The Potomac River, which separates the two states, is not equally divided; instead, nearly the entire river falls under Maryland’s jurisdiction, with the border marked by a low water line on the Virginia side.
This legal quirk led to the rise of riverboat casinos along the Virginia shoreline in the 1950s. While gambling was illegal in Virginia, it was permitted in parts of Maryland. As a result, visitors could park in Virginia, walk across a pier into Maryland, and board riverboat casinos to gamble legally.
A similar situation unfolded in Missouri after a 1994 vote amended the state constitution to allow “games of chance” on the Mississippi and Missouri rivers. However, a later state supreme court ruling required that casinos be in direct contact with the water, invalidating several that operated in moats. Eventually, riverboat casinos were built on stilts over navigable waters to comply with the law.
These legal loopholes highlight the creative ways gambling establishments navigated state laws to operate within legal boundaries.
Riverboat Gambling Today
Times have changed, and many states now permit casino gaming. While riverboat casinos have mostly become a thing of the past, they still operate in Louisiana and Mississippi. However, they are no longer required to set sail and typically remain docked.
